ZCC INTERDICT RULING
The Lobatse High Court today, after ruling that the matter is urgent, ordered the ZCC and Bishop Lekganyane not to hold any disciplinary hearings against the 17 Applicants pending the conclusion of their case before the High Court of Gaborone. The disciplinary charges include taking the ZCC to court.
The Applicants’ case before the Gaborone High Court seeks the Court to order that the ZCC and the Bishop are violating the ZCC Constitution by not holding Annual General Meetings and by not appointing a Minister to oversee and lead the ZCC in Botswana.

OSCAR PISTORIUS TRIAL
The South African Supreme Court overturned Oscar Pistorius’ manslaughter conviction for shooting his girlfriend in February 2013, and found him guilty of murder.

4 SUSPENDED JUDGES FAIL TO INTERDICT THE PRESIDENT
The Court handed down judgment in the matter where 4 Judges sought to interdict the President from appointing a tribunal to investigate the Judges on allegations of misbehavior. The application was dismissed with costs.

We warmly and without reservation welcome this decision. This decision is not victory for Mr Khwarae alone. It is victory for all men who have, or will have, children outside the realms of marriage. Most importantly it is victory for all children born out of wedlock because the court has emphasised that their best interests reign supreme over their mothers’ interests. At the heart of any adoption case henceforth, the primary factor will be what is key for the child and not what the mother wants.
This case is monumental and timely. Not only will this case enhance our jurisprudence, it will also impact on people’s lives. We can’t think of any past decision that has impacted on so many people’s lives. For one to appreciate the magnitude of this case, one has to think of the men and women who have children outside marriage and also think of children born of unmarried parents. It is a life changing judgment and will affect those conceived or still to be born.
We are happy to have been part of this. We thank Mr Khwarae for allowing us to turn his seemingly ordinary case into a constitutional case. When he walked through Ndadi Law Firm offices, he had no idea that his case will be this big and it took numerous consultations to make him see the big picture. All he wanted was his child but what he got is his child and a change of law to benefit similarly situated men and children.
